Peru Law No. 31814 Promoting the Use of Artificial Intelligence

Peru’s framework law promotes the ethical, sustainable, transparent, replicable and responsible use of artificial intelligence within the national digital-transformation process, prioritising people and respect for human rights. It designates the Presidency of the Council of Ministers, through the Secretariat of Government and Digital Transformation, as the national technical and regulatory authority.

Law No. 31814 establishes six principles for the development and use of AI: risk-based safety standards, multi-stakeholder participation, internet governance, the digital-society approach, ethical development for responsible AI, and privacy. It declares AI development, digital talent and the use of emerging technologies for public services and national economic and social activity to be matters of national interest. The Presidency of the Council of Ministers, acting through the Secretariat of Government and Digital Transformation (SGTD), must direct, evaluate and supervise AI use and promotion, foster skills, digital and data infrastructure, ethical guidelines and national and international collaboration. The authority must report annually to Congress on implementation of the National Digital Transformation Policy and National AI Strategy and immediately notify Congress’s Intelligence Commission when it identifies serious threats or a breach of national cybersecurity.
